Although it is not feasible to predict what the High Court of Australia—the nation’s apex legal body—would do if it were called upon to consider the constitutionality of vaccine mandates and emergency declaration orders, it is still possible to argue what it should do.
The Australian Constitution must be interpreted in a manner that promotes its purposes, values, and principles, while advancing the “rule of law” and the fundamental rights of the citizen.
The idea of mandatory vaccination—which is now steadily underway in Australia to combat the spread of COVID-19—sits uncomfortably with this jurisprudence.
The Constitution expressly limits the exercise of government power to protect the rule of law. This limitation reduces the incidence of unrestrained power, which is closely connected to achieving human freedom and happiness.
Accordingly, the Constitution allocates legislative power over certain health services to the federal government (or Commonwealth), with these powers being exclusive or concurrent to those wielded by the Australian states.
However, Section 51 (xxiiiA) of the Australian Constitution, which was added following a referendum in 1946, provides that the Commonwealth Parliament can make laws with respect to: “The provision of … pharmaceutical, sickness and hospital benefits, medical and dental services (but not so as to authorize any form of civil conscription), benefits to students and family allowances.”

Australia, non-compliance may be the only way out of this. We cannot comply with the illegal actions of governments, whether state or federal. Civil disobedience may be the only way out of this.
The state of South Australia is trialing a new surveillance tool. South Aussies are required to download an app on their smartphones, which all need to have with GPS switched on. The app randomly requires that they send a photo of their face — with facial recognition software of course — which tells the governing overloads where the person is at that time. If they are not at home the gestapo is sent around to their house; probably to take them into custody. Well, whenever they find them anyway.

In 1979 truckies blockaded the roads in to protest against horrendous road taxes and won against the government of the day.
Tomorrow, August 31, 2021, the truckies in the eastern states (at least) are planning to do something similar. At the same time there has been planned another protest, this time a silent protest across Australia at Government Houses and local council offices. This time the stakes are much higher — our freedoms and the right to live in a free democratic society.
Right at this moment the Australian federal government (not North Korea) has passed a bill in the parliament, the Identify and Disrupt Bill 2021, which when assented to by the Governor-General, will give the Australian Federal Police (AFP) and all those other surveillance agencies the power to remove any of your social media content, to read and delete your emails, and even to alter and send emails and messages from your accounts. Sounds a lot like a communist regime doesn’t it. Well, that is because it is. (Even this post would be deleted under that legislation.)
